Benallal Bookkeeping (“we,” “us,” or “our”), located in Harris County, Texas, is committed to maintaining the confidentiality and security of your non-public personal information (NPI). This policy describes our practices regarding the collection, use, and protection of your data in accordance with Texas state law and federal standards.

2. Information We Collect

In the course of providing bookkeeping services, we collect information that identifies, relates to, or describes you or your business. This includes:

  • Sensitive Personal Information: Social Security Numbers (SSN), Employer Identification Numbers (EIN), and driver’s license numbers.
  • Financial Account Information: Bank account numbers, credit/debit card numbers, and access credentials for accounting software.
  • Business Records: General ledgers, tax returns, payroll records, and financial statements.
  • Contact Information: Name, phone number, email address, and mailing address.

How We Collect Your Information

We collect your information through the following methods:

  • Signed physical or digital engagement letters and service contracts.
  • Email correspondence and direct communication with you.
  • Accounting software portals (e.g., QuickBooks Online) that you grant us access to.
  • In-person meetings or document handoffs.
  • Contact or intake forms submitted through our website or office.
  • Verbal opt-in during onboarding conversations with our staff.

3. Duty of Care & Data Security

In compliance with Texas Business & Commerce Code Chapter 521, we maintain a comprehensive information security program.

  • Encryption: We use industry-standard encryption for all digital transmissions of sensitive data.
  • Restricted Access: Access to your sensitive personal information is strictly limited to authorized personnel who require it to perform bookkeeping duties.
  • Physical Security: Any physical documents containing sensitive information are stored in a secure, locked location and destroyed via professional shredding services when no longer needed.

Data Sharing

Customer data is not shared with 3rd parties for promotional or marketing purposes. Mobile opt-in and consent are never shared with anyone for any purpose. Any information sharing that may be mentioned elsewhere in this policy excludes mobile opt-in data and SMS consent.

Benallal Bookkeeping Messaging Terms and Conditions

1. The messaging program consists of general conversational messaging to answer questions and provide support to customers.

2. You can cancel the SMS service at any time. Just text STOP to the phone number from which you received messages. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

3. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at Kristina@benallalbookkeeping.com.

4. Carriers are not liable for delayed or undelivered messages.

5. As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency will vary based on communication needs. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

4. How We Use Your Information

We use your information exclusively to:

  • Perform bookkeeping, reconciliations, and financial reporting.
  • Prepare and process payroll or 1099 filings.
  • Facilitate communication regarding your business’s financial health, including appointment reminders, account notifications, and service updates.
  • Comply with IRS regulations and Texas state tax requirements.

5. No Sale of Information

Benallal Bookkeeping does not sell, rent, or lease client lists or any personal information to third parties. We do not share your information with outside marketers. Customer information is never shared with third parties or affiliates for marketing or promotional purposes.

6. Data Transfer and Disclosure Policy

We do not transfer or disclose consumer data to any external organizations for any purpose, even with your consent.

We strictly prevent all unauthorized sharing of user data to protect your privacy.

All client data remains strictly within Benallal Bookkeeping and is used solely to perform the bookkeeping services you have engaged us for. Any tools or software platforms used to deliver our services (e.g., QuickBooks Online) operate under strict confidentiality and are not considered external disclosures of your data. We do not share, sell, rent, or disclose your information to outside parties.

7. Disposal of Records

In accordance with Texas Business & Commerce Code § 72.004, we follow strict procedures for the disposal of business records. When your information is no longer required for legal or business purposes, we will take all reasonable steps to make the personal information unreadable or undecipherable through shredding, erasing, or otherwise modifying the data.

8. Data Breach Notification

In the unlikely event of a data breach involving your sensitive personal information, Benallal Bookkeeping will notify you and the Texas Attorney General’s office in accordance with the timelines and requirements set forth in Texas Business & Commerce Code § 521.053.

9. Your Rights

Under Texas law, you have the right to:

  • Inquire about the categories of data we have collected about you.
  • Request the correction of inaccurate financial or personal data.
  • Withdraw consent for our access to your banking or software portals at any time.
  • Request that we stop sending you SMS messages at any time by replying STOP to any message.

SMS Communication Policy

Program Description

Benallal Bookkeeping uses SMS to provide you with timely updates regarding your account. Types of messages you may receive include appointment reminders, account notifications, and service updates. Additional messages may include requests for missing documents (receipts, bank statements), tax deadline alerts, payroll notifications, and brief responses to your bookkeeping inquiries.

How to Opt-In

To receive text messages from us, you must provide your prior express written consent. You can do this by signing a physical or digital engagement letter that includes an SMS consent clause, by texting START to our business number at (832) 669-6300, or by providing verbal consent during onboarding using our staff opt-in script below.

How to Opt-Out

You have the right to stop receiving messages at any time. To opt out, simply reply STOP, UNSUBSCRIBE, or QUIT to any text message you receive from us. After you send STOP, we will send you one final SMS to confirm that you have been unsubscribed.
